1. Acceptance of Terms

By accessing or using Watershed ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and Cabin Fever LLC ("Company," "we," "us," or "our"), the operator of Watershed.

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use Watershed. By using the Platform, you represent and warrant that you are 18 or older. If we discover that a user is under 18, we will terminate their account and delete any associated data.

You must have the legal capacity to enter into a binding agreement and must not be barred from using the Platform under applicable law.

3. Nature of the Service — Not a Clinical Service

Watershed is an AI-powered emotional support tool informed by the knowledge of licensed therapists. It is designed to provide general emotional support, psychoeducation, and coping resources. It is not a substitute for professional mental health care.

By using the Platform, you acknowledge and agree that:

• Watershed is not a licensed mental health provider and does not establish a therapeutic relationship with you
• No licensed clinical relationship exists between you and Cabin Fever LLC or any of its contributors
• The AI responses you receive are not clinical recommendations and should not be treated as such
• You should seek professional mental health care for diagnosis, treatment, or crisis support
• Watershed is not designed for or appropriate for users in acute mental health crisis

4. Crisis and Emergency Situations

If you are experiencing a mental health emergency, are in danger of harming yourself or others, or believe someone else is in danger, you must contact emergency services immediately.

Watershed is not monitored by clinical staff and cannot dispatch emergency services. Do not rely on the Platform in a crisis situation.

5. User Accounts and Registration

To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update that information as needed.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello.watershed@gmail.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the Platform or other users.

6. Conversation Data and Storage

Watershed may store your conversation history to provide continuity across sessions — enabling the Platform to reference prior interactions when you return. By using the Platform, you consent to this storage.

You acknowledge that:

• Your conversation data is stored on secure servers and subject to our Privacy Policy
• Conversation data may be used to improve the Platform's responses to you across sessions
• Conversation data will not be sold to third parties
• You may request deletion of your conversation data at any time by contacting hello.watershed@gmail.com

7. Acceptable Use

You agree not to use Watershed to:

• Impersonate any person or entity or misrepresent your identity
• Attempt to gain unauthorized access to the Platform or its underlying systems
• Transmit any content that is unlawful, threatening, abusive, or harassing
• Use the Platform for any commercial purpose without our express written consent
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or knowledge base
• Interfere with or disrupt the integrity or performance of the Platform
• Use automated means (bots, scrapers) to access or collect data from the Platform

8. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to the AI knowledge base, user interface, design, and underlying technology — are owned by Cabin Fever LLC and are protected by intellectual property laws.

You retain ownership of content you submit to the Platform (including your conversation inputs). By submitting content, you grant Cabin Fever LLC a limited, non-exclusive license to use that content solely to operate and improve the Platform.

You may not reproduce, distribute, or create derivative works from any Platform content without our express written permission.

9. Subscription and Payment

Watershed currently offers a free tier allowing access to the Platform for up to four sessions. Continued access beyond the free tier requires a paid subscription. Pricing and subscription terms will be presented at the time of upgrade.

All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. We reserve the right to modify pricing with reasonable advance notice to subscribers.

10. Disclaimers and Limitation of Liability

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cabin Fever LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, and expenses (including reasonable attorneys' fees) arising from your use of the Platform or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Berkshire County, Massachusetts.

You waive any objection to jurisdiction or venue in such courts.

Cabin Fever LLC ("we," "us," or "our") operates the Watershed platform. We take the privacy of your personal and conversation data seriously — particularly given the sensitive nature of emotional health discussions. This Privacy Policy explains what data we collect, how we use it, and your rights over it.

By using Watershed, you consent to the practices described in this Policy.

2. Data We Collect

2.1 Account Information

When you create an account, we collect:

• Name and email address
• Password (stored in hashed, non-recoverable form)
• Date of account creation
• Age confirmation (self-attestation of 18+ status)

2.2 Conversation Data

When you use Watershed, we collect and store:

• The full text of your conversation inputs and AI responses
• Timestamps of each message
• Session identifiers linking conversations across multiple sessions

Conversation data is among the most sensitive information we handle. We treat it accordingly and do not use it for purposes beyond those described in this Policy.

2.3 Voice Data

If you use the voice (text-to-speech) feature, audio is generated in real time and is not stored on our servers. Voice synthesis is handled by ElevenLabs; please review their privacy policy for details on their data handling.

2.4 Usage Data

We automatically collect certain technical information when you use the Platform:

• Browser type and version
• Device type and operating system
• Pages visited and features used
• Session duration and frequency
• IP address (used for security and fraud prevention, not linked to conversation content)

2.5 Notes Tool Data

If you use the in-app notes or journaling feature, your notes are stored and linked to your account. This data is subject to the same protections as conversation data.

3. How We Use Your Data

We use your data solely for the following purposes:

• To operate and provide the Watershed platform
• To enable conversation continuity across sessions (AI context)
• To improve AI response quality and platform features
• To communicate with you about your account
• To detect and prevent fraud, abuse, and security threats
• To comply with legal obligations

We do not sell your data to third parties. We do not use your conversation data for advertising. We do not share your conversation data with other users.

4. Data Storage and Security

4.1 Where Your Data Is Stored

Your data is stored in a secured cloud database (Supabase/PostgreSQL) with encryption at rest and in transit. Application infrastructure is hosted on Vercel. Both providers operate with industry-standard security controls.

4.2 Security Measures

• All data transmitted between your device and our servers is encrypted via TLS
• Conversation data is encrypted at rest
• Access to user data is restricted to authorized personnel only
• We implement row-level security controls so individual user data is isolated

4.3 Pseudonymization

To further protect your privacy, we separate directly identifying information (such as your name and email address) from your conversation data using a unique internal identifier. Your conversation records are stored under this identifier rather than under your name. Only authorized personnel with access to the linking key can connect your identity to your conversation history. This approach limits exposure of sensitive conversation content in the event of a data incident.

4.4 Data Retention

We retain your conversation data for as long as your account is active. If you delete your account, we will delete your conversation data within 30 days, except where retention is required by law.

5. Third-Party Service Providers

We share data with the following third-party providers solely to operate the Platform:

• Application hosting: Vercel
• Database storage: Supabase
• AI language model (conversation processing): Anthropic
• Speech-to-text transcription: AssemblyAI
• Text-to-speech voice synthesis: ElevenLabs
• Vector database (knowledge base retrieval): Pinecone

Each provider processes only the data necessary to perform their service. We do not authorize any provider to use your data for their own purposes beyond service delivery.

5.1 International Data Transfers

Some of our third-party service providers — including Anthropic, ElevenLabs, AssemblyAI, and Pinecone — may process your data on servers located outside the United States or the Commonwealth of Massachusetts. By using the Platform, you consent to the transfer of your information to these providers in accordance with this Privacy Policy.

We take steps to ensure that any international transfers are handled with appropriate safeguards and in compliance with applicable law. However, please be aware that data transferred internationally may be subject to the laws of the countries in which it is processed, which may differ from the laws of your home jurisdiction.

5.2 Third-Party AI Services

Watershed uses Anthropic's Claude API to power AI-generated responses within the app. When you send a message, the text content of that message is transmitted to Anthropic's servers for processing. Anthropic returns a generated response which is displayed to you in the app.

• What is shared with Anthropic: the text content of your conversation messages.
• What is not shared: your name, email address, payment information, or any other personally identifiable information beyond the message content itself.
• Purpose: to generate contextually appropriate AI responses to your messages.

Anthropic's data practices are governed by their own Privacy Policy, available at anthropic.com/privacy. Anthropic does not use your conversation data to train their models and provides data protection equivalent to the standards described in this policy.

Watershed does not share your data with any other third-party AI services or sell your data to any third parties.

6. Your Rights

You have the following rights regarding your personal data:

• Access: Request a copy of the data we hold about you
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your account and associated data
• Portability: Request your conversation data in a portable format
• Objection: Object to certain uses of your data

You may also request deletion of your conversation data directly within the Platform by using the account settings menu. Once confirmed, deletion will be processed within 30 days.

7. Sensitive Data

Watershed is designed for emotional support conversations, which may include sensitive disclosures — including but not limited to mental health history, trauma, substance use, and relationship issues. We treat all conversation data as sensitive by default and apply heightened protections accordingly.

We do not use sensitive disclosures for profiling, targeting, or any purpose other than providing the continuity features described in this Policy.

8. Minors

Watershed is not intended for users under 18 years of age. We do not knowingly collect data from minors. If we become aware that a user is under 18, we will delete their account and all associated data promptly. If you believe a minor has created an account, contact us at hello.watershed@gmail.com.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes by email and will post the updated Policy on the Platform. Continued use of the Platform following notice of changes constitutes acceptance of the revised Policy.
